Terms of Service

1. Accounts

You must be at least 13 years old to create an account. Recipients (the birthday person) can be any age; we only collect their name and a photo you upload.

2. Likeness & content

You warrant that you have the right to any photo you upload. Don't upload images of others without their permission. We screen uploads for prohibited content and reject anything unsafe.

3. Music

"Happy Birthday to You" is in the public domain following the 2016 Warner/Chappell ruling in the US/UK/EU. Backing tracks are licensed to BirthdayStudio for use inside the product. Personal use is fine; for commercial use of generated videos, contact us.

4. YouTube uploads

When you opt in to YouTube delivery, videos are uploaded to our shared channel as unlisted by default. We never upload to your own channel. By choosing YouTube delivery you agree to be bound by the YouTube Terms of Service. Our use of YouTube API Services is described in our Privacy Policy, and Google's handling of data in the Google Privacy Policy.

5. Acceptable use

No harassment, slurs, sexual content involving minors, deepfakes intended to deceive, or other unlawful uses. We reserve the right to remove content and terminate accounts that violate these terms.

6. Liability

BirthdayStudio is provided "as is." Our liability is limited to the amount you have paid us in the past 12 months.
